Expungement Services
An arrest record can negatively impact your life. If you were convicted of an Indictable or Disorderly Persons Offense your conviction is available for anyone to see. Charges that were dismissed or arrests that resulted in an adjudication of not guilty will still appear on your record.
Determining Eligibility
The first step in determining Eligibility is obtaining a copy of your criminal record. A review of your criminal record will help in ascertaining whether the appropriate amount of time has passed since your last conviction, whether you were convicted of an indictable offense (felony), a disorderly persons offense (misdemeanor) or a municipal ordinance violation. A review of your criminal record will also help determine the total number of convictions you have incurred. These determinations are important because Eligibility depends on the answers to these questions.
How Long Do I Have to Wait?
You must wait a certain amount of time to expunge your record depending on the type of offense you were convicted of. Dismissals have no waiting period, Young Drug Offender offenses (offenses adjudicated under 21) have a one year waiting period. Municipal Ordinances have a two year waiting period. A juvenile can expunge their record three years from the date they were discharged from legal custody or supervision. Generally, there is a five year waiting period for indictable and disorderly persons offenses.
