The first step in determining Eligibility is obtaining a copy of your criminal record. A review of your criminal record will help in ascertaining whether the appropriate amount of time has passed since your last conviction, whether you were convicted of an indictable offense (felony), a disorderly persons offense (misdemeanor) or a municipal ordinance violation. How Long Do I Have to Wait?

You must wait a certain amount of time to expunge your record depending on the type of offense you were convicted of. Dismissals have no waiting period, Young Drug Offender offenses (offenses adjudicated under 21)  have a one year waiting period. Municipal Ordinances have a two year waiting period. A juvenile can expunge their record three years from the date they were discharged from legal custody or supervision. Generally, there is a five year waiting period for indictable and disorderly persons offenses.
